- Eligibility/Entries: You must be
at least eighteen (18) years of age at the time of entry and a legal
resident of the United States (excluding Puerto Rico). You must also
be a professional in the landscape contractor market. Employees of the
Lawn & Landscape Media Group, Sweepstakes sponsors, and members
of each of their families (spouses, parents, children, and siblings
and their spouses) and those living in the same household of each are
not eligible. Limit one entry per person regardless of method of entry.
Sweepstakes begins online 12:01 a.m. (ET) 11/11/2008 and ends online 11:59
p.m. (ET) 12/8/2008. Entrants agree to be bound by the terms of these
Official Rules.
To enter, go to http://www.lawnandlandscape.com, click on the Sweepstakes link, and complete the registration form by entering your name, street address, city, state, ZIP code, email address, telephone number, and company information. By entering this sweepstakes, entrants give their express permission to be contacted by Sponsor by telephone, email and/or mail. Entrants must provide a valid email address to enter online. Entries will be declared made by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned the email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Proof of being the authorized account holder may be required. Online entries must be submitted by 11:59 p.m. (ET) on 12/8/2008.
Limit one prize per person or household. Sponsor reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable. All taxes, fees, surcharges or other expenses associated with the acceptance and/or use of the prize are the sole responsibility of the prize winner. Prize winners will be issued a 1099 tax form for the retail value of the Prize. Prize is not transferable, assignable or redeemable for cash. No prize substitutions, except as provided herein.
- Awarding Prizes/Winner Notification:
One (1) Grand Prize Winner will be selected in a random drawing
on or about 12/11/2008 from all eligible entries received. Drawing will
be conducted by the Lawn & Landscape Media Group, the judges of
this sweepstakes, whose decisions are final and binding in all matters.
Odds of winning depend upon the total number of eligible entries received.
Winners will be notified by e-mail on or about December 12, 2008. All prizes
will be awarded if properly claimed.
By accepting prizes, winners grant the Lawn & Landscape Media Group, affiliates, sales representatives, distributors, and advertising and promotional agencies (“Sponsor and its Agents”), the right to use and publish winners’ proper names, states of residence and likenesses for advertising and promotional purposes online and in print, or in any other media worldwide, in connection with the sweepstakes without limitation and without compensation except where prohibited. All prize winners will be required to sign and return an affidavit of eligibility and a liability and publicity release (where permitted) within seven (7) days after notification. Noncompliance with these requirements, ineligibility, or return of any prize/prize notification as undeliverable, may result in disqualification and selection of an alternate winner.
- Limitations of Liability: Sponsor
and its agents are not responsible for lost, late, illegible, incomplete,
or for any computer, online, telephone or technical malfunctions or
delays that occur in the processing transmission or receipt of entries,
or for inaccurate transcription of entry information, for any human
error, or for entries that are stolen, misdirected, garbled, lost or
delayed by computer transmissions. If, for any reason, the sweepstakes
is not capable of being conducted as planned, including, but not limited
to, infection by computer virus, bugs, tampering, unauthorized intervention,
fraud, technical failures, or other causes beyond the control of Sponsor,
Sponsor reserves the right at its sole discretion to cancel, terminate,
modify or suspend the sweepstakes. By accepting prizes, winners agree
to release Sponsor and its Agents from any and all liability, loss or
damage of any kind incurred with respect to the awarding, receipt, possession,
and/or misuse of any prize or to participation in prize-related activities.
Sweepstakes is governed by the laws of the U.S., with venue in Ohio.
All claims must be resolved in the U.S.
