Bayer CropScience LP filed a lawsuit against Control Solutions of Pasadena, Texas, and Frick Services of Wawaka, Ind., for infringement of Bayer’s patent for the pesticide imidacloprid on fertilizer.
Bayer filed the lawsuit in the U.S. District Court for the Eastern District of North Carolina citing infringement of U.S. Patent No. 5,783,203.
Bayer invented the novel mixture of imidacloprid on fertilizer, sold as the brand name product Merit PlusTurf Fertilizer; and it has been used for more than 10 years, according to the company. The patented technology is designed to insect control on lawns and golf courses while providing significant application convenience to users.
Bayer Environmental Science, a business unit of Bayer CropScience, provides products to professionals and consumers for turf and ornamentals, termite control, general insect control and vector control applications.
