Fertilizer, consider yourself regulated in Bonita Springs, Fla.
Despite concerns from their staff over whether the ordinance will even be enforceable, city council voted 4-3 Wednesday to approve regulating fertilizer use in the city. The ordinance is similar to those passed by the Lee County Board of County Commissioners and the Naples City Council earlier this year.
When the ordinance goes into full effect a year from now, those spreading nitrogen and phosphorous-based fertilizers will need to do so at least 10 feet away from any body of water, including ditches in front yards. Fertilizer-users will also not be allowed to spread during the rainy season from June 1 to Sept. 30.
Businesses that use the fertilizers would need to have their workers certified and registered with the city.
First offense violations will result in a fine of $100. A third or more offenses will result in a $500 fine.
Councilmen Pat McCourt, Bill Lonkart and Richard Ferreira dissented.
