Bayer sues Syngenta

Bayer CropScience filed suit against Syngenta yesterday that Syngenta's Appear fungicide infringes a patent as well as relies on false superiority claims over Bayer's Chipco Signature fungicide.

The suit, filed in a federal court in North Carolina, involves the use of phthalocyanine in the products. According to Bayer's complaint, in its advertising for Appear, Syngenta uses the “falsely or misleading claim that Appear fungicide delivers improved stress tolerance and greater pythium and anthracnose control than your current Chipco Signature program," which is not corroborated by efficacy trials.
