WEST BEND, Wis. – A Wisconsin man has been charged with driving drunk on his lawn mower.
Barry Davis, 44, was in Washington County Circuit Court on Aug. 27 on a charge of operating a motor vehicle while intoxicated. The man admitted to drinking a six-pack of beer but said he didn't know driving a lawn mower while intoxicated was illegal.
A criminal complaint said an officer pulled Davis over after seeing the mower swerving and watching it nearly go into a ditch to avoid traffic.
The case has raised the issue of what's considered a motor vehicle.
Washington County Assistant District Attorney Peter Cannon said state statute defines a motor vehicle as any vehicle that is self-propelled.
Davis spent Tuesday night in Washington County Jail and was then released after signing a $750 signature bond. He is scheduled to return to court Sept. 3 for further proceedings.
